Perbuatan yang pada umumnya dipandang sebagai perbuatan yang keliru,
dalam kejadian yang tertentu itu dipandang sebagai perbuatan yang dibenarkan,
bukanlah perbuatan yang keliru. Sebaliknya apabila tidak dipidananya seseorang
yang telah melakukan perbuatan yang mencocoki rumusan delik disebabkan
karena tidak sepantasnya orang itu dicela, tidak sepatutnya dia disalahkan, maka
hal-hal yang menyebabkan dia tidak sepantasnya dicela itu disebut sebagai hal-hal
yang dapat memaafkannya. Seperti hal nya contoh kasus yang penulis teliti yaitu
mengenai alasan penghapusan pidana yang lebih menekankan kepada adanya
alasan pembenar dalam perbuatannya, yakni dalam Putusan
No.671/Pid.Sus/2020/PN.PTK. Penelitian ini untuk mengetahui analisis hukum
tentang alasan pembenar dalam hukum pidana, bentuk alasan pembenar sebagai
dasar peniadaan hukuman bagi pelaku tindak pidana narkotika dalam Putusan
No.671/Pid.Sus/2020/PN.PTK, serta pertimbangan hakim dalam
mempertimbangkan alasan pembenar sebagai dasar peniadaan hukuman bagi
pelaku tindak pidana narkotika dalam Putusan No.671/Pid.Sus/2020/PN.PTK.
Metode penetian ini menggunakan jenis penelitian yuridis normatif dengan
data sekunder yang diperoleh secara studi kepustakaan (library research).
Kemudian, data diolah dengan menggunakan analisis kualitatif.
Berdasarkan hasil penelitian diketahui bahwa alasan pembenar termasuk
sebagai bagian dari alasan penghapus pidana. Bentuk alasan pembenar sebagai
dasar peniadaan hukuman bagi pelaku tindak pidana narkotika dalam Putusan
No.671/Pid.Sus/2020/PN.PTK termasuk dalam bentuk alasan pembenar karena
perintah jabatan sebagaimana yang terdapat dalam Pasal 51 ayat (1) KUHP.
Pertimbangan hakim dalam mempertimbangkan alasan pembenar sebagai dasar
peniadaan hukuman bagi pelaku tindak pidana narkotika dalam Putusan
No.671/Pid.Sus/2020/PN.PTK yakni hakim mempertimbangan fakta-fakta hukum
yang terungkap di dalam persidangan, hakim juga mempertimbangan penerapan
unsur yang diajuka oleh Jaksa dalam dakwaanya, serta hakim juga
mempertimbangan terhadap adanya alasan pembenar sebagai dasar peniadaan
hukuman bagi terdakwa

Industrial relations had increasingly complex problems when the era of industrialization began. Many disputes that arise between workers or workers and employers, workers with the government, trade unions or labour unions with employers and many other conflicts require official institutions to settle a dispute of industrial relations. So that the formation the act of the republic Indonesia No. 2 of the year 2004 concerning of Industrial Relations Disputes Settlement. This paper has praise to find out the implementation and industrial relations disputes settlement through the court of Industrial relations, in addition to strengthening the mediation function in resolving industrial relations disputes, and making that a judicial institution capable of providing legal justice for labourer and workers. The results of this paper conduct settlement of industrial relations in the court, which consists of several disputes concerning human rights, interest disputes, over termination of employment, between labour unions in one company disputes. So that the mediation is needed for the settlement of industrial relations disputes, because it is indeed far better and faster to resolve when compared to being resolved in the court of industrial relations. Bearing in mind that the industrial relations disputes settlement can be implemented at the court of industrial relations it will take a long time. In addition, to strengthen the Industrial Relations Court, concrete efforts are needed to realize the principle of fast, simple and low cost, so that litigants can obtain justice which is the core of a court process.

Following Article 102 of The 2003 Manpower Act, In Carrying Out Industrial Relations, Workers And Trade Unions Have The Function of Carrying Out Work Following Their Obligations Maintaining Order For The Continuity Of Production, Democratically Channeling Aspirations, Developing Skills And Expertise As Well As Participating In Advancing Companies And Fighting For Welfare. Members And Their Families. Likewise With The Position Of The Labor Union In the Job Creation Bill, Which In Essence The Roles And Functions And Position Of The Workers' Union In The Job Creation Bill Are Not Much Different From The Roles And Functions Of Trade Unions In The Manpower Law.
